THE EUROPEAN COMMISSION,<\/p>\n\n\n\n

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2024\/1143 of the European Parliament and of the Council of 11 April 2024 on geographical indications for wine, spirit drinks and agricultural products, as well as traditional specialities guaranteed and optional quality terms for agricultural products, amending Regulations (EU) No 1308\/2013, (EU) 2019\/787 and (EU) 2019\/1753 and repealing Regulation (EU) No 1151\/2012, and in particular Article 21(2) thereof,
Whereas:
(1) Pursuant to Article 50(2), point (a), of Regulation (EU) No 1151\/2012 of the European Parliament and of the Council, Italy\u2019s application for registration of the geographical indication \u2018Capocollo di Martina Franca\u2019, which the Commission had received before the date of entry into force of Regulation (EU) 2024\/1143, was published in the Official Journal of the European Union.
(2) No statement of opposition under Article 17 of Regulation (EU) 2024\/1143, which is applicable to the application for registration in accordance with Article 90(2) of that Regulation, has been received by the Commission.
(3) The geographical indication \u2018Capocollo di Martina Franca\u2019 should therefore be entered in the Union register of geographical indications.
(4) The Italian authorities informed the Commission in letters received on 19 February 2024 and 5 March 2026 that the companies Comalbest s.r.l. and Industria Alimentare Apulia s.r.l., which had been legally marketing a product under the sales name \u2018Capocollo di Martina Franca\u2019, using that name continuously for more than five years, were not complying with the product specification, in particular by not being established in the geographical area laid down in the product specification. The point had been raised in the national opposition procedure.
(5) Since the requirements laid down in Article 20(1), point (b), of Regulation (EU) 2024\/1143, which are applicable to the application for registration in accordance with Article 90(2) of that Regulation, are met, a transitional period should be granted to the companies Comalbest s.r.l. and Industria Alimentare Apulia s.r.l.to allow them to continue using the name \u2018Capocollo di Martina Franca\u2019. In the light of the information provided by the Italian authorities, this transitional period should last for five years from the entry into force of this Regulation,<\/p>\n\n\n\n

HAS ADOPTED THIS REGULATION:<\/p>\n\n\n\n

Article 1<\/strong>
The geographical indication \u2018Capocollo di Martina Franca\u2019 (PGI) is hereby entered in the Union register of geographical indications referred to in Article 22 of Regulation (EU) 2024\/1143<\/a>.<\/p>\n\n\n\n

Article 2<\/strong>
The companies Comalbest s.r.l. and Industria Alimentare Apulia s.r.l. are authorised to continue using the name \u2018Capocollo di Martina Franca\u2019 for a period of five years from the entry into force of this Regulation.<\/p>\n\n\n\n

Article 3<\/strong>
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.<\/p>\n\n\n\n
